Post Study Work in Australia falls under the Temporary Graduate Visa category under subclass 485. The category is further divided into two streams

  1. Express Entry is a new immigration program.

Hence it doesn’t automatically grant a Permanent Residency (PR) status but increases the chances for qualifying under the system.   2.  Express Entry is the only way you can become a Canadian economic immigrant.
    Express Entry covers most economic immigration programs, but individual provinces can still pick immigrants from outside of the Express Entry system based on their provincial labor market needs under a base ‘Provincial Nominee Program’ (PNP).   3. Anyone can enter the Express Entry Pool.

    Express Entry currently does not include an eligible occupation list or occupation caps. Candidates only need to establish that they have at least one year of experience in a skilled occupation within the last 10 years. This expands the eligibility scope for the potential candidates. However, one needs to check if the select occupation is classified as skilled under the National Occupational Classification (NOC) codes or isn’t listed in ineligible occupations for the Canadian Experience Class (CEC).
  6. You don’t need to pass any language tests to enter the Express Entry pool
    CIC confirms that all candidates must demonstrate their language proficiency in either English or French to be included in the Express Entry pool. Hence they need to pass a standardized English or French language test to be eligible to apply.
  7. When you’re invited to apply for permanent residence as an Express Entry candidate, you’ll have plenty of time to gather all the documents and submit your application
    The deadline to submit your application once you receive the Invitation to Apply (ITA) is 60 days. If you wait until the ITA is issued you may struggle to gather all the documents, including personal documents, qualifications, credentials, references, recommendation letters, accredited forms, etc., required to submit your application in the required time.

Getting a Driver’s license in Australia after your migration

Being able to drive a car in a foreign country like Australia is an advantage. The driving laws and regulations differ from state to state in Australia. Things you should know about the Australian Driver’s License Process

  • The computer-based theory test can be taken at any RTA. There is no restriction on the number of attempts to clear the test, but you need to pay a fee of AUD 30 for each attempt.

  • Applicant should have completed at least half of the studies from a publicly funded college or university in Canada
  • He/ She must hold at least a 2-year full-time degree or diploma, or at least 1-year post-graduate degree or certificate program in which case he should have a previous degree or diploma from abroad
  • Applicant must have a permanent, full-time job offer in a skilled occupation (NOC levels 0, A, or B), which is approved and remain valid at time student’s application is approved.
  • He/She should submit an application within 2 years of receiving the Canadian degree or diploma.

2) International Ph.D. Graduate stream

  • Must have graduated from an existing Ph.D. program at an eligible publicly funded university in Ontario, or successfully completed all required degree programs, or have at least 2 years of completed Ph.D. studies from a publicly funded university in Ontario.
  • Submit application within 2 years from receiving a Ph.D.
  • It does not require applicants to have a job offer.
  • Should be a legal resident if living in Canada.

3) Pilot International Masters Graduate –

  • It is a pilot program that accepts only 1000 applicants.
  • The applicant should intend to live and work in Ontario
  • He/she must have graduated from an existing Masters program at an eligible publicly funded university in Ontario
  • Candidate must enroll in a one-year full-time course
  • He/ she should apply within 2 years from completion of a Masters degree and must have stayed in Ontario for at least one year within the last two years

How to apply for OINP?

a) Application for OINP can be made after receiving the original documents from the employer which includes –

  • Pre-Screen Approval Letter,
  • Job Offer Letter,
  • Pre-Screen Position Form,
  • Joint Verification Form

b) Applications must be submitted within 60 days of issue-date of Pre-screen position form, beyond which the approved position is no longer eligible

c) Submit the Nominee Application Form with Authorizing or Cancelling a Representative Form

d) Nominee Application Form must be submitted in English or French, with supporting documents like birth certificates, passport, educational certificates, etc., as per the checklist. A translation of documents, certified by Association of Translators and Interpreters of Ontario (ATIO), can be submitted if the form is in another language.

e) The form needs to be notarized if submitted from outside Ontario

f) Only share the copies of supporting documents unless specifically stated. Do not submit originals of civil documents as the application will not be returned.

g) The non-refundable application fee, as applicable, must be paid in Canadian dollars in either certified cashier cheque, money order or a bank draft addressed to the Ontario Minister of Finance.

Take advantage of Parent and GrandParent Program reopened in Canada till 2nd Feb 2017

Canada’s immigration laws are constantly evolving to make it more immigrant-friendly. They also support having a family together with amicable spouse and family visa programs. In a similar move, Canada reopened its Parent and Grandparent Program (PGP) this year, for a limited period from 3rd Jan 2017. The Canadian citizens and permanent residents can fill out an online interest to sponsor the form until noon on February 2nd, 2017.

Earlier the PGP worked on a first-come, first-serve basis. However, due to a large backlog in application processing, the Canadian government introduces a quota of 5000 PGP sponsorship applications per year. Hence the number of applicants actually getting through under PGP was restricted. The current government has changed the PGP intake system and doubled the quota to 10,000 applicants each year with a lottery system for processing visas.

The new intake system for PGP is very similar to Express Entry for skilled workers. But instead of the CRS ranking system to allot the ITA, PGP will be issued at random within the pool. While it adds a certain uncertainty in visa success, the PGP system is expected to effectively address the backlog issue for the category visas.

How can you apply under PGP?

 

It should be duly noted that –

  • The online interest to sponsor form is not a PGP application.
  • The online interest to sponsor form does not require any documents or proof of income.
  • You only need to provide is the full name, date of birth, country of birth, home address, and email address.
  • You only need to prepare your PGP application once you receive the ITA.
  • IRCC will communicate via email if you are not selected for ITA, in which case you can submit your interest in sponsoring next year.

Are you eligible to sponsor your parent or Grandparent?

To sponsor your parent or grandparent, you need to provide medical, criminal and background checks, which needs to be submitted only once you receive an ITA.

To be eligible to sponsor your parent or grandparent in 2017, you must:

  1. Be over 18 years of age and living in Canada
  2. Be a citizen or hold permanent residency in Canada;
  3. Sign a sponsorship agreement that commits you to provide financial support for your sponsored parent or grandparent when required,
  4. Promise to provide financial support for the relative and any other eligible relatives accompanying them for a period of 3 – 10 years, depending on their age and relationship to you.
  5. Meet the minimum income requirements for the past 3 years.
  6. Provide income statements from the Canada Revenue Agency (CRA) for 2015, 2014, and 2013.

How to obtain an Australian Skilled Visa under subclass 457?

The Australian Skilled Work Visa under subclass 457 allows Australian and overseas employers to sponsor an immigrant worker. It falls under a work sponsorship visa category. It allows the immigrant skilled worker to enter, stay and work in Australia for up to 4 years. The 457 visa also allows the candidate’s family to gain entry, study and work in Australia during the tenure of their stay. It does not put any restriction on the number of times the candidate or his family can enter or leave the country during the visa tenure.

You may need to back up your application with copies of qualifications, references or recommendation letters to prove your credentials match the job skills required. For e.g: Certain professionals would need a degree to qualify, but some occupations can qualify with 5 years of experience in similar work. Trade workers would need a certificate of apprenticeship to prove their credentials or 3 years of work experience as applicable.

5) Check if you need a bridging visa to avoid becoming illegal while your visa is processed.
If you are already in Australia on a valid visa while submitting your Visa 457 application, you will be issued a bridging visa by immigration. The 457 visa involves three stages – Business Approval, Nomination, and Actual Visa. The bridging visa is issued once your actual visa part is submitted.

Here are the changes that lie ahead for Canada Immigration in 2017

Canada has always had some of the most migrant-friendly immigration and visa policies to attract and retain international talent from all over the world. Immigration, Refugees and Citizenship Canada (IRCC) has already vamped up quite a few visa rules in 2016 to ensure an easy and smooth migration to Canada. Some of the visa changes that are bound to have a big impact on Canadian immigration in 2017 include –

  • The targets for immigration categories are changed. While the overall immigration target is set at similar levels of last year at 300,000, the immigration for economic categories has been increased by 7% to 172,500.
  • Changes are made to the CRS Ranking System.
    •  Up to 30 additional CRS points awarded for Canadian educational credentials if a candidate applies through Express Entry System.
    •  Candidates claiming a job offer will be granted either 200 or 50 CRS points depending on the occupational NOC code.
  • Openwork permit pilot is extended till December 2017  Spouse Sponsorship Visa will be processed within 12 months in 2017
  •  A lottery system for Parent and Grandparent sponsorship Visa, which will also accept 10,000 applications in 2017
  • Four-in Four-out regulation revoked for Temporary Foreign Workers

There are also some other changes that are announced or under consideration and might come into effect sometime in 2017. The expected amendments include –

  • CRS Ranking System may be further refined. Candidates with siblings in Canada may get an advantage with additional CRS points awarded. IRCC is also considering awarding bonus points to French-speaking candidates with strong English proficiency.
  • One can expect changes in some types of work permits under the Global Skills Strategy. The Canadian government has committed to processing visas and work permits within two-weeks for low-risk and high-skill talent for companies in Canada. They are also looking to introduce a new work permit exemption for less than 30 days stay in a year, or even brief academic stays.
  • IRCC is considering removing the conditional Permanent Residence(PR) cohabitation rule which currently prevails which mandates the spouses, common-law and conjugal partners who are in a relationship for 2 years or more without any children to live together for at least 2 years to retain their PR status.
  • The dependent child’s definition will be restored to under 22 years of age.
  • The federal government is looking to create a federal program under Express Entry for semi-skilled workers for Permanent Residency.
  • More changes can be expected for the Temporary Foreign Worker Program, which has received 21 recommendations by the standing committee on Human Resources, Skills, and Social Development in September 2016.
